They also need to be nominated by an Australian state or territory government agency or must be sponsored by an eligible relative in a regional area of Australia. The applicant’s occupation should fall in STSOL or ROL. The application process begins with the submission of an Expression of Interest (EOI), in which candidates designate their preferred state/territory for nomination or indicate having an eligible family for sponsorship in regional Australia. In addition to the EOI, depending on the state, some may require a separate application for state nomination, whereas others prefer candidates to express their intention for nomination in the EOI, with an invitation to apply for nomination extended if the applicant meets the criteria.

Following nomination or sponsorship acceptance, the candidate receives an Invitation to Apply from the Department of Home Affairs, with a sixty-day deadline to submit the visa application. Upon approval of the Subclass 491 visa, the main visa holder and accompanying family members must validate their visas by entering Australia within a certain time frame.

Australia Skilled Work Regional (Provisional) Visa

The Subclass 491 visa has a 5-year validity period and is subject to specific conditions, especially Condition 8579, which emphasizes the government's intention for visa holders to stay, work, and study exclusively in regional areas. It is possible to travel between distinct regional places. In this context, regional areas exclude large cities such as Sydney, Melbourne, Brisbane, Perth, and the Gold Coast, which are classified as non-regional. Your job is open to any occupation and employer as long as it meets the work and residency conditions of the visa. Furthermore, holders of the new provisional visas will be ineligible for other skill-based visas in Australia unless they have completed a minimum of three years in a designated regional region unless exceptional circumstances emerge. Similarly to the existing framework for subclass 457 and 482 visas, instances of noncompliance by sponsors could have an adverse effect on holders of the new provisional visas.

The Subclass 191 Permanent Residence (Skilled Regional) visa is the route to permanent residency via the new 491 visa. To qualify for this permanent visa, applicants must have maintained a subclass 491 or 494 visa for a duration of at least 3 years and adhered to the associated visa conditions.
