Canada has updated its procedures of verification for immigration language test results. The changes strengthen the existing verification measures. The updated measures do not change Canada's language test requirements or approved testing organizations.
Officers are instructed to compare the photographs of the applicant to validate the language test results. They have to conduct thorough checks of case notes and testing provider-issued Info-Alerts, to detect possible language test fraud. Any suspected cases must be documented and referred to the Tips and Reports Management Unit (TMRU) for further investigation. Officers have to do the verification procedures at every stage of application processing before a final decision is made. Unlike the previous guidelines, the revised instructions no longer mention allowing applicants to retake a language test under visa office supervision. If fraud is confirmed, then the application may be refused for misrepresentation, subject to procedural fairness requirements.
Language proficiency is a critical eligibility requirement for most economic immigration programs, including Express Entry. Applicants have to demonstrate their English or French language skills through an approved third-party testing organization, with results converted into the Canadian Language Benchmark (CLB) for English or the Niveaux de compétence linguistique canadiens (NCLC) for French.
The new measures ensure that the applicants meet the language requirements through lawful means. It will maintain the credibility and fairness of the Canadian immigration system and also uphold public confidence in the selection process.
